Implicit processes almost certainly preceded explicit processes in our evolutionary history, so they are likely to be more resistant to disruption according to the principles of evolutionary biology [Reber, A. Seventh Circuit Allows Informed Consent Claim Under FTCA.M. S. W. - 1996 - Journal of Law, Medicine and Ethics 24 (1):71-72.
The United States Court of Appeals for the Seventh Circuit held, in Murrey v. United States ), that claims for a physician's failure to obtain a patient's informed consent are not barred by the Federal Tort Claims Act as a species of misrepresentation. The court further held that the claim was not barred by the failure to include the issue of informed consent in the administrative claim. This decision reduces the burden on plaintiffs to state every cognizable claim consistent with (...)

    The Morality of Law. [REVIEW]L. M. W. - 1966 - Review of Metaphysics 20 (2):367-367.
Based on the 1963 Storrs Lectures at Yale, these four related essays are an attempt to clarify Fuller's conception of a procedural, non-substantive natural law, which requires that such characteristics as generality, promulgation, non-contradiction, etc., be present in any genuine legal system. These requirements, he indicates, can never all be perfectly met, and hence the "inner morality of law" must remain largely a morality of "aspiration" rather than of "duty." The third essay, entitled "The Concept of Law," is rather disappointing (...)

The objectives of this study were to develop a high-density chromosome bin map of homoeologous group 7 in hexaploid wheat, to identify gene distribution in these chromosomes, and to perform comparative studies of wheat with rice and barley. We mapped 2148 loci from 919 EST clones onto group 7 chromosomes of wheat. In the majority of cases the numbers of loci were significantly lower in the centromeric regions and tended to increase in the distal regions. The level of duplicated loci (...)

A total of 1918 loci, detected by the hybridization of 938 expressed sequence tag unigenes from 26 Triticeae cDNA libraries, were mapped to wheat homoeologous group 4 chromosomes using a set of deletion, ditelosomic, and nulli-tetrasomic lines. The 1918 EST loci were not distributed uniformly among the three group 4 chromosomes; 41, 28, and 31% mapped to chromosomes 4A, 4B, and 4D, respectively. This pattern is in contrast to the cumulative results of EST mapping in all homoeologous groups, as reported (...)

"Since the end of the last century," Walter Benjamin wrote, "philosophy has made a series of attempts to lay hold of the 'true' experience as opposed to the kind that manifests itself in the standardized, denatured life of the civilized masses. It is customary to classify these efforts under the heading of a philosophy of life. Towering above this literature is Henri Bergson's early monumental work, Matter and Memory."Along with Husserl's Ideas and Heidegger's Being and Time, Bergson's work represents one (...)

This article aims to further test the cognitive claims of the so-called subjectivity account of causal events and their linguistic markers, causal connectives. We took Mandarin Chinese, a language that is typologically completely different from the usual western languages, as a case to provide evidence for this subjectivity account. Complementary to the commonly used corpora analyses, we employed crowdsourcing to tap native speakers’ intuitions about causal coherence, focusing on four result connectives kějiàn ‘therefore’, suǒyǐ ‘so’, yīncǐ ‘so/for this reason’ and (...)

Mitigating response distortion in answers to sensitive questions is an important issue for business ethics researchers. Sensitive questions may be asked in surveys related to business ethics, and respondents may intend to avoid exposing sensitive aspects of their character by answering such questions dishonestly, resulting in response distortion. Previous studies have provided evidence that a surveying procedure called the randomized response technique is useful for mitigating such distortion. However, previous studies have mainly applied the RRT to individual dichotomous questions in (...)

Even though integrity is widely considered to be an essential aspect of research, there is an ongoing debate on what actually constitutes research integrity. The understanding of integrity ranges from the minimal, only considering falsification, fabrication and plagiarism, to the maximum, blending into science ethics. Underneath these obvious contrasts, there are more subtle differences that are not as immediately evident. The debate about integrity is usually presented as a single, universal discussion, with shared concerns for researchers, policymakers and ‘the public’. (...)

Closely examining Locke's view of original sin and its consequences for education in the early Enlightenment, Spellman here argues that Locke was much closer to traditional Protestant teaching than is generally recognized, and challenges the interpretation that sees Locke as advocating, through his philosophical and educational writings, the perfectibility of humankind.
